Yara Technologies (Pvt) Limited (“we”, “us”, “our”) owns and operates the website at www.eduloan.lk (the “Website”). Please read the following terms of use (“Terms of Use”) before using the Website or any services that may be made available through the Website, including the EduLoan platform (collectively, the “Services”). By accessing and using the Services you agree to be bound by these Terms of Use. If you do not agree with these Terms of Use, your sole recourse is to immediately cease visiting the Website or using Services.

OWNERSHIP & RESTRICTIONS ON USE

Any and all content, data, graphics, photographs, images, audio, video, software, systems, processes, trademarks, service marks, trade names and other information including, without limitation, the “look and feel” of the Website (collectively, the “Content”) contained in the Services are proprietary to us, our affiliates and/or third-party licensors. The Content is protected by copyright and trademark laws.

Except as set forth herein, you may not modify, copy, reproduce, publish, post, transmit, distribute, display, perform, create derivative works from, transfer or sell any Content without our express prior written consent. You may download, print and reproduce the Content for your own non-commercial, informational purposes provided you agree to maintain any and all copyright or other proprietary notices contained in such Content, and to cite the URL source of such Content. EDULOAN

Through the Website we provide general information on the nature of and access to various types of educational loans and other educational financial products, in addition to comparison information in relation to such educational loan products and providers. We do not charge any fees to you for providing this service but are paid by the third party product or service providers. We partner with recognised educational institutions and reputed financial institutions and facilitate requests for educational loans. You (as a parent, guardian, students or joint applicant of a partner educational institution) can use the EduLoan platform to request a loan from a partner financial institution. If you apply for an educational loan using our Website, you provide consent to us to share the information you have provided to us with our partner financial institutions. You acknowledge that this consent is effective immediately upon submitting your application and is being obtained to enable partner financial institutions to determine your eligibility for an educational loan. We provide the information you provide through the Platform to partner financial institutions in order to allow them to assess whether to prequalify you for an educational loan. If you pre-qualify you are not guaranteed approval. You will still need to submit an application with the partner bank relating to the educational loan.

You understand and agree that in order to assess the request you make through this platform the financial institution may use the information you are providing to conduct relevant checks, including via 3rd parties including CRIB.

You are responsible for obtaining the consent of any person (including a joint applicant) on whose behalf you submit personal information and other information through the Website. In the event you do not have the express consent to the collection, use, and disclosure to us or the Financial Institution of another person's information, then you should not provide such information to us or the Financial Institution. You shall be solely responsible for your unauthorised use of another person's information and shall indemnify us and hold us harmless from all claims, demands and liabilities arising from your unauthorised use of another's information.

INFORMATION ON FINANCIAL PRODUCTS

We or our partner financial institutions may send or otherwise provide you with information and offers about other financial products or services that may be of interest to you (“Related Products”). We make no representations or guarantees regarding your eligibility or qualification for such Related Products. In some instances, you may use the EduLoan platform to request Related Products from a partner financial institution. Where we do not provide the facility for you to make a request through the Edu Loan platform, you can contact the partner financial institution directly. By making a request through the EduLoan platform you provide consent to us sharing the information you have provided with our partner financial institutions. You acknowledge that this consent is effective immediately upon submitting your request and is being obtained to enable partner financial institutions to determine your eligibility for any Related Products. You may be requested by the partner financial institution to submit an application directly to the partner financial institution. You understand and agree that we are merely providing you with information that may be of interest to you, and that we have no control over or responsibility for Related Products or any loss that you may suffer as a result of the use of such Related Products. You should exercise your own judgment and obtain any expert advice you consider necessary prior to entering into an arrangement with a partner financial institution.

THIRD PARTY LINKS

The Website and the Service might offer you links to other sites that are owned and operated by third parties and therefore not operated by us. Please understand that such linked websites are independent from us and that we have no control over the content of such websites and your use of such third party websites and the content of such third party websites is entirely at your own risk. Consequently, we cannot be held liable and make no warranty or representation whatsoever as to the accuracy, timeliness and/or completeness of the information contained on such websites or in relation to any transactions you may undertake through such third party websites.

USER UNDERTAKINGS

As a condition of your continued access to and use of the Services, you agree to abide by all applicable laws and regulations and you agree not to upload, post, e-mail or otherwise transmit any material that:

These Terms of Use shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka and any dispute is to be submitted to a court of competent jurisdiction in Sri Lanka.

If any provision of the present Terms of Use shall be unlawful, void, or for any reason unenforceable, then such provision shall be severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
